1. Introduction

Welcome to the Zalomi.com service provided by Zalomi. By using the Zalomi.com service, you are deemed to have accepted the terms and conditions listed below. All products/services and information displayed on Zalomi.com (or any of its other domain) constitute an "invitation to offer." Your order for purchase constitutes your "offer," which shall be subject to the terms and conditions listed below. Zalomi.com reserves the right to accept or reject your offer. If you provide a valid email address, we will notify you by email to confirm receipt of your order and again to confirm details and process the order. Our acceptance of your order will take place upon dispatch of the product(s) ordered. No act or omission of Zalomi.com prior to the actual dispatch of the product(s) ordered will constitute acceptance of your offer.

2. Membership Eligibility

Use of the Site is available only to persons who can form legally binding contracts under applicable law. Persons who are "incompetent to contract" as per local Contract Acts are not eligible to use the Site. If you are a minor, i.e., under the age of 18 but at least 13 years old, you may use this Site only under the supervision of a parent or legal guardian who agrees to be bound by these Terms of Use. If your age is below 18 years, your parents or legal guardians can transact on your behalf if they are registered users/members. You are prohibited from purchasing any material intended for adult consumption, the sale or purchase of which to/by minors is strictly prohibited. Zalomi.com reserves the right to terminate your membership and refuse access to the Site if Zalomi.com discovers that you are under 18. The Site is not available to persons whose membership has been suspended or terminated by Zalomi.com for any reason. If you are registering as a business entity, you represent that you have the authority to bind the entity to this User Agreement. Those who choose to access this Site from outside the UAE are responsible for compliance with local laws. Zalomi.com will deliver products only within its jurisdiction and will not be liable for any claims relating to products ordered from outside its jurisdiction. Except where additional terms and conditions are provided which are product-specific, these terms and conditions supersede all previous representations, understandings, or agreements and shall prevail, not withstanding any variance with any other terms of any order submitted. By using the services of Zalomi.com, you agree to be bound by the Terms and Conditions.

3. Account and Registration Obligations

"Your Information" is defined as any information you provide to us in the registration, buying, or listing process, in the feedback area, or through any email feature. We will protect Your Information in accordance with our Privacy Policy. If you use the Site, you are responsible for maintaining the confidentiality of Your Account and Password and for restricting access to your computer. You agree to accept responsibility for all activities that occur under Your Account or Password. Zalomi.com shall not be liable for any loss or damage which may arise as a result of any failure by you to protect your password or account. If Zalomi.com has reason to believe there is likely to be a breach of security or misuse of the Zalomi.com Site, we may require you to change your password or suspend your account without liability to Zalomi.com.

If you provide any information that is untrue, inaccurate, incomplete, or not current, or if Zalomi.com has reasonable grounds to suspect that such information is untrue, inaccurate, incomplete, or not in accordance with the User Agreement, Zalomi.com has the right to suspend or terminate your membership and refuse access to the Site indefinitely.

5. Pricing Information

While Zalomi.com strives to provide accurate product and pricing information, pricing or typographical errors may occur. Zalomi.com cannot confirm the price of a product until after you order. In the event that a product is listed at an incorrect price or with incorrect information due to an error, Zalomi.com shall have the right to refuse or cancel any orders placed for that product unless the product has already been dispatched. In the event of an incorrect pricing situation, Zalomi.com may contact you for instructions or cancel your order and notify you of such cancellation. Unless the product ordered by you has been dispatched, your offer will not be deemed accepted, and Zalomi.com will have the right to modify the price of the product and contact you for further instructions. In the event that Zalomi.com accepts your order, the same shall be debited to your credit card account and duly notified to you by email that the payment has been processed. If we have to cancel the order after processing the payment, the said amount will be reversed back to your credit card account. No cash disbursement shall be made under any condition whatsoever. We strive to provide the best prices possible on Zalomi.com and in all our stores. However, prices online may differ from store prices due to local pricing strategies.

6. Delivery

It typically takes 2 – 7 business days to deliver your order within the UAE. Delivery outside city limits may incur additional charges and will notify accordingly.

Express Delivery is a faster delivery option available for select products, generally delivering orders within 24 -48 hours if ordered within the city limits of UAE. This service is indicated on the website with a specific badge.

7. Cancellation

Zalomi.com reserves the right to cancel any order at its sole discretion for any reason. Situations that may lead to order cancellation include, but are not limited to, limitations on quantities available for purchase, inaccuracies or errors in product or pricing information, or issues identified by our credit and fraud avoidance department. If we cancel your order, we will notify you and refund any amounts charged to your credit card.

8. Cancellations by the Customer

If you wish to cancel an order, you must do so before the order has been processed. Once the product has been shipped, the cancellation option will no longer be available. However, you can receive the product at your designated delivery address and initiate a return through the "My Orders" section of your Zalomi Account Page.

9. Credit Card Details

You agree and confirm that the credit card details you provide for availing of services on Zalomi.com will be correct and accurate. You shall not use a credit card that is not lawfully owned by you. Zalomi.com will not share your credit card information with third parties except for fraud verification or as required by law. Zalomi.com will not be liable for any credit card fraud. The liability for fraudulent use of a card will be on you, and the onus to prove otherwise shall be exclusively on you.

10. Transactions

Zalomi.com reserves the right to recover the cost of goods, collection charges, and lawyer fees from persons using the Site fraudulently. Zalomi.com may also initiate legal proceedings for fraudulent use of the Site and other unlawful acts.

11. Transactional Restrictions

Orders may be blocked under certain circumstances, such as using cards issued outside specific regions or exceeding a daily transaction limit. In such cases, customers can request refunds.

12. Electronic Communications

When you visit Zalomi.com or send emails to us, you are communicating with us electronically. You consent to receive communications from us electronically. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement for such communications to be in writing.

13. You Agree and Confirm

You agree and confirm that you will use Zalomi.com for lawful purposes and comply with all applicable laws. You also agree to provide true information in all instances where requested. Zalomi.com reserves the right to confirm and validate the information provided by you. If any information is found untrue, Zalomi.com has the right to reject your registration and bar you from using Zalomi.com services.

14. Colors

While we strive to display product colors accurately, the actual colors you see will depend on your monitor. We cannot guarantee that your monitor’s display will be accurate.

15. Shipping

Shipping costs above 200AED is free for all Zalomi registered users and for the order below 200AED, the Delivery charges are based on package weight, dimensions, method of shipment, and destination or it will be a fixed amount calculated by Zalomi management. International shipments may involve additional costs such as duties, taxes, and customs clearance fees.

16. Cash on Delivery

Cash on Delivery (COD) is available for products and there will be a non-refundable convenience charge for COD payments. The maximum limit for COD is AED 5000.

17. Return & Exchange

All returns are subject to Zalomi's Return & Exchange Policy. Products must be returned in the same condition as received and with original packaging intact. Refunds for credit/debit card payments may take 7 to 14 business days. Refunds will be processed as Zalomi gift cards.
Warranty
The services provided by Zalomi.com are offered on an "as is" basis and zalomi will provide you with a warranty policy that helps you stay covered in case of defects in functionality and workmanship after purchase of the product. Repair or replacement under the terms of this warranty does not provide the right to extension or renewal of the warranty period. The warranty does not apply in the following circumstances and not limited to, Items are mis-used or mis-handled, Items have been accidentally damaged, Water damaged. The listed warranty is not covered for the data loss, physical damage, etc and limited to the functionality of the product only. We disclaim all warranties, conditions, and representations, whether express, implied, or statutory, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, compatibility, security, and the accuracy or reliability of the services. We do not warrant that the services will be uninterrupted, timely, secure, or error-free, or that defects will be corrected.

Store Pickup
Store Pickup is available if its mentioned on the listing at designated Zalomi Store locations. Orders must be collected within 7 days, with specific documents required for pickup.

18. Copyrights

Our website www.zalomi.com contains materials including software, images, text, illustrations, programs, digital downloads, music and video clips and written and other material that are part of this website (referred as the ‘content’). We own the contents or materials or portions of the content may be made available to us through arrangements that we are entered into with third parties. Unauthorized use of the content or material or portion of the content may result in the violation of our copyright, trademark, and other rights under the appropriate legislature. You have no right to the content or material or portion of the content and you will not use, display, copy the same or you may not sell, transfer, assign, license or modify the content or reproduce, display, distribute or otherwise use the content in any way for any public or commercial purpose. You are not allowed to use the said content is permissible without our prior written consent.

19. Modification of Terms & Conditions of Service

Zalomi.com may modify the Terms & Conditions at any time without prior notice. Continued use of the service after any changes indicates acceptance of the modified Terms & Conditions.

20. Governing Law and Jurisdiction

This User Agreement is governed by the laws of the UAE. Any disputes will
be resolved in the courts of the UAE.

21. Limitation of Liability

Zalomi.com will not be liable for any indirect, incidental, punitive, or consequential damages arising from the use of, or inability to use, the Site. This includes, but is not limited to, damages for loss of data, business, profits, goodwill, etc., whether based on contract, tort, negligence, or otherwise.
